Message	my manual cars parked somewhere, whether at the store or in the garage, I ALWAYS put them in gear out of habit. A prime example is bobby12many, whose e-brake failed overnight letting his car roll down a hill and into a tree. Had it been in gear, it doubtfully would have moved more than a few inches. It's something I owuld do if I borrowed a friends car, etc. I'm not sure about the specifics, but it doesn't seem like you have a very strong case in terms of a lawsuit. There are too many factors. Glad you are OK, though.
